From billion-dollar awards to what next?
Investor State Dispute Settlements, ISDS, has in recent years met critique after high publicity cases where companies have been awarded billions of dollars in damages from poor countries. So, what is ISDS – and what is the purpose behind reforming ISDS?
We asked Anna Joubin-Bret, Secretary of the United Nations Commission on International Trade Law, UNCITRAL: United Nations Commission on International Trade Law, after she featured a panel on security for costs in international arbitration, at the SCC.
– ISDS is an exceptional means of settling disputes that arise from a foreign investment enterprise by a foreign investor in a state which is not his own and which allows, which is an important risk and therefore it's part of the protection that is given in addition to the attraction to the promotion to foreign investors by sovereign states that wish to attract foreign investment to their economy, says Secretary Joubin-Bret.
