Last week saw the conclusion of a modernized version of the Energy Charter Treaty (ECT). The SCC Arbitration Institute is one of the arbitration institutions entrusted with the resolution of disputes under the ECT. SCC Board member Barton Legum took part in an important discussion organized by the International Energy Charter Secretariat on Energy Transition Disputes under the Modernized Energy Charter Treaty on behalf of the SCC. According to Bart, while all participants in the panel hailed the reforms implemented by the modernized treaty, each noted the important role for participants and institutions in ECT arbitrations to make sure that the policy goals behind the new treaty are realized.
