The Moot Problem has now been released, marking the start of the written phase ahead of oral rounds at the International Arbitration Centre in London, 18โ22 February 2027.
This year's case, ๐๐ญ๐ญ ๐๐ฃ๐ฐ๐ถ๐ต ๐๐ฉ๐ข๐ต ๐๐ฆ๐ต ๐ท. ๐๐ช๐ฏ๐จ๐ฅ๐ฐ๐ฎ ๐ฐ๐ง ๐๐ณ๐ข๐ง๐ข๐ญ๐จ๐ข๐ณ, invites teams to address some of the most pressing questions in investment arbitration today, including:
๐ Indirect expropriation and the scope of a State's regulatory powers
๐ The use of a most-favoured-nation clause to invoke fair and equitable treatment under a terminated treaty
๐ The participation of a non-disputing treaty Party
We're especially pleased to see the SCC Arbitration Rules (2023) feature directly in the problem, giving teams the opportunity to engage with our framework in a live, practical setting.
