SCC Secretary General Caroline Falconer has contributed data and statistics from SCC's investment arbitration caseload to the IBA's newly published 𝘙𝘦𝘱𝘰𝘳𝘵 𝘢𝘯𝘥 𝘙𝘦𝘤𝘰𝘮𝘮𝘦𝘯𝘥𝘢𝘵𝘪𝘰𝘯𝘴 𝘰𝘯 𝘛𝘩𝘪𝘳𝘥-𝘗𝘢𝘳𝘵𝘺 𝘗𝘢𝘳𝘵𝘪𝘤𝘪𝘱𝘢𝘵𝘪𝘰𝘯 𝘪𝘯 𝘐𝘯𝘷𝘦𝘴𝘵𝘮𝘦𝘯𝘵 𝘈𝘳𝘣𝘪𝘵𝘳𝘢𝘵𝘪𝘰𝘯.
The report, authored by the IBA Investment Arbitration Subcommittee, maps the rapid growth of third-party participation in investor-state dispute settlement and puts forward seven recommendations aimed at promoting greater clarity and consistency in how tribunals handle such applications.
Among the findings, the report confirms that all eleven TPP applications made in SCC arbitrations were granted, reflecting SCC's transparent and well-established procedural framework for managing third-party participation under Appendix III of the SCC Arbitration Rules (2023).
